Test Drive Terms & Condition – Ireland.
Thank you for choosing to test drive with MINI. To drive one of our cars;
1. You must have held a valid driving licence issued in UK, EU, USA, Canada, Australia, New Zealand, Barbados, Hong Kong, Monaco, Singapore, Falkland Island, Republic of Korea, South Africa, Switzerland, Faroe Islands, Japan, Zimbabwe, British Virgin Islands for at least 12 months immediately before the date of your test drive.
2. If you are driving on a non-UK licence, the licence must have 12 months validity. If you have surpassed 12 months of driving within the UK, a UK licence must be obtained prior to test driving our vehicles.
3. You must have accumulated no more than nine points on your driving licence or committed any serious offences in the three years immediately before the date of your test drive.
4. You must not have been disqualified from driving within the five years immediately before the date of your test drive.
5. You meet all legal requirements, and are otherwise fit and able, to drive the test drive vehicle.
The Detail:
You will be required to sign a test drive contract, by signing the terms you confirm that meet all the above conditions and that you will not let anyone else drive the vehicle. If you do not meet all the above conditions this may invalidate the vehicle’s insurance and you may be liable for any costs, losses, claims and expenses that arise as a result of you using the vehicle.
You must return the vehicle to the location from which you collected it (or such other location as you have agreed in writing with the MINI Retailer) before the end of your test drive time.
If your test drive is for one hour or less you may drive the vehicle for a maximum of 100 kilometres during your test drive. Provided that you return the vehicle on time and within the maximum permitted mileage you do not need to refuel or recharge the vehicle. However, if you exceed either of these limits you must return the vehicle refuelled to the original level. If you do not MINI may charge you for the fuel used. MINI may also charge you €1 (excluding VAT) for each mile you drive in excess of the maximum permitted mileage.
If your test drive is for more than one hour, then you will need to provide the MINI Retailer with two forms of ID (at least one of which must be a photo ID and the other must confirm your current address). The MINI Retailer will inform you of the maximum mileage the vehicle can be driven. If during the test drive the vehicle suffers any damage or there is an insurance claim associated with the vehicle or your test drive you will be liable for the cost of repairing the damage or the insurance excess, in each case up to a maximum of €600. If damage is less than excess, only the damage cost will be charged to the customer.
MINI is the owner of the vehicle and will ensure it meets all legal and safety requirements for a test drive. MINI will also arrange the insurance for your test drive. If you are aged 21 or less on the date of the test drive, you can only test drive vehicles up to insurance group 33.
Purpose:
The vehicle may only be used for a test drive. It is not permitted to:
1. Transfer the vehicle to another person or allow anyone else to drive the vehicle.
2. Drive the vehicle if you are prohibited from driving, do not have a valid driving licence or are otherwise unfit to drive.
3. Use the vehicle to transport people (other than those participating in the test drive) or goods, whether or not for payment.
4. Participate in motorsport events of any kind, including associated practice sessions.
5. Drive the vehicle on unpaved roads.
6. Tow trailers, vehicles or other objects.
7. Drive the vehicle outside of Ireland
8. Smoke or vape in the vehicle.
9. Disable and/or switch off driving assistance systems such as ESP/DCS, etc.
Handover and use of the vehicle:
You must use the vehicle legally and in accordance with the manufacturer’s instructions and with all due care at all times. You must check the vehicle for damage before driving it and tell the MINI Retailer if you see any damage. Do not replace or remove any part of the vehicle or any vehicle accessories. Do not attempt or permit any repairs to the vehicle.
MINI’s liability:
MINI’s liability in connection with the provision of the vehicle for the test drive or otherwise under these terms, whether such liability arises as a result of MINI’s negligence or otherwise, shall to the maximum extent permitted by law, be excluded.
MINI’s rights arising from your use of the test drive vehicle
You indemnify MINI against third-party claims as a result of your use of the vehicle to the extent such claims are not covered by MINI’s insurance.
You are responsible for, and indemnify MINI against, all costs and claims arising from the use of the vehicle during your test drive including (but not limited to) speeding fines, parking fines, congestion charges etc. MINI is entitled to make payments when they are claimed and to recover the costs from you.
What to do in the event of an accident:
An accident refers to any event in road traffic that results in personal injury or damage to property. If the vehicle is involved in an accident or stolen you must inform MINI and MINI Retailer as soon as possible. In addition, immediately call the police and prepare a written accident report. This written report must contain the following information and must be sent directly to MINI:
1. Date, time and location of the accident.
2. Name and contact details as well as your bank details, e.g. credit card information, SEPA direct debit and any country-specific information.
3. Information concerning the driver’s licence and those involved in the accident:
Category/issuing authority/date of issue.
4. Addresses and insurance numbers of the parties involved in the accident as well as the licence plates of all vehicles involved in the accident.
5. Detailed accident report (including drawing) and names and addresses of potential witnesses.
6. Extent of damage (property damage, injuries, deaths).
7. Current location of the vehicle.
8. In the event of damage, MINI reserves the right to charge the driver a processing fee of €39 incl. VAT.
Return of the vehicle
Please return the vehicle at the end of the test drive period to the agreed return location during normal business hours. The return shall not be deemed to have taken place until a MINI Retailer employee has accepted the vehicle and signed the Test Drive Return Form .
MINI or a MINI retailer may demand the return of the vehicle at any time. MINI may terminate the test drive without notice even before the vehicle is handed over to you without providing a reason.
Consent to vehicle tracking:
Throughout the test drive, you agree that MINI, as the owner of the vehicle, may track and process its location using vehicle and trip-related data. If vehicle tracking is deactivated, MINI may take reasonable measures to locate and regain possession of the vehicle and charge you for its costs doing so.
General provisions for test drives:
These terms contain the entire agreement relating to the handover and return of the vehicle, and to the test drive.
